Privacy Policy
1. Introduction and Scope
1.1 This Privacy Policy describes how Clayface, a product of Phyllo, collects, processes and uses data. “Phyllo” collects, obtains, uses, stores, discloses and otherwise processes Personal Data in connection with Clayface.
1.2 Clayface is an enterprise intelligence platform that enables organisations to obtain actionable intelligence by analysing their own first-party data together with external information collected, licensed, organised and enriched by Clayface. Clayface may be made available to brands, creators, companies and other organisations for business research, market intelligence, creator intelligence, analysis and other approved purposes.
1.3 This Privacy Policy applies to Personal Data processed in connection with the Clayface platform, associated websites, customer and user accounts, demonstrations, sales activities, customer support, business communications, Clayface and other services that refer to this Privacy Policy. The Clayface platform, websites and associated services are referred to collectively in this Privacy Policy as the “Services”.
1.4 For the purposes of this Privacy Policy, “Personal Data” means any information relating to an identified or identifiable individual. References to Personal Data include equivalent terms such as “personal information” where those terms are used under applicable privacy laws.
1.5 This Privacy Policy applies differently depending on whether Clayface processes Personal Data on behalf of a Customer or for its own purposes. Where we process information submitted by a Customer, the applicable Customer agreement and data processing addendum may contain additional or more specific terms. Where there is a conflict concerning the processing of Customer Content, the applicable contractual terms will govern to the extent permitted by law.
2. Definitions
2.1 Customer means an organisation or legal entity that enters into an agreement with Clayface to access or use the Services.
2.2 Authorised User means an individual who is authorised by a Customer to access or use the Services on the Customer’s behalf.
2.3 Customer Content means data, documents, files, databases, records, communications, instructions and other content submitted, uploaded, connected or otherwise made available to the Services by or on behalf of a Customer.
Customer Content may include a Customer’s internal business information, first-party data, documents, databases, prompts, instructions, queries, messages, tenant-specific embeddings, indexes, AI-generated outputs, completions and other content processed within the Customer’s individual environment.
2.4 Clayface External Intelligence means information obtained independently of Customer Content and collected, licensed, organised, indexed, maintained or enriched by Clayface for the purposes of providing research, retrieval, analysis and intelligence functionality.
Clayface External Intelligence may include information obtained from publicly accessible sources, licensed data providers, data brokers and other third-party sources. It may also include information produced by normalising, deduplicating, classifying, connecting, summarising or otherwise analysing source information.
2.5 Customer Environment means the individual and logically isolated tenant provisioned for a Customer through which the Customer accesses and uses the Services.
2.6 Account and Business Data means Personal Data processed in connection with a Customer relationship, including information about Authorised Users, account administrators, billing contacts, business representatives, prospective customers and other individuals who interact with us in a business capacity.
2.7 Service Data means technical, operational, administrative, security and usage information generated or collected in connection with the provision, operation and administration of the Services. Service Data does not include the substantive contents of Customer files, prompts or AI-generated outputs except where such content is voluntarily provided to us as part of a Customer-authorised support request.
3. Persons Covered by this Privacy Policy
3.1 This Privacy Policy may apply to visitors to the Clayface website, prospective Customers and their representatives, Customers, Authorised Users, account administrators, billing contacts, individuals who contact us or request support, individuals whose Personal Data is contained in Customer Content and individuals whose Personal Data forms part of Clayface External Intelligence.
3.2 The provisions applicable to an individual will depend on the circumstances in which the individual’s Personal Data was obtained and the capacity in which Clayface processes that information.
4. Our Role in Processing Personal Data
4.1 Customer Content
Where a Customer submits or makes Customer Content available through its Customer Environment, the Customer ordinarily determines why and how that Customer Content is processed. In those circumstances, the Customer ordinarily acts as the controller, business or equivalent responsible entity, and Clayface ordinarily acts as the processor, service provider or equivalent entity processing the Customer Content on the Customer’s behalf.
4.2 We process Customer Content only in accordance with the applicable Customer agreement, the data processing addendum, the Customer’s documented instructions and applicable law.
4.3 Clayface External Intelligence Where Clayface independently collects, licenses, organises, maintains, enriches or otherwise determines the purposes and means of processing Clayface External Intelligence, Clayface ordinarily acts as an independent controller, business or equivalent responsible entity.
4.4 A Customer that accesses or uses Clayface External Intelligence for its own purposes may separately act as an independent controller or business in relation to its subsequent use of that information. The Customer is responsible for ensuring that its use of Clayface External Intelligence complies with applicable law, its agreement with Clayface and any use restrictions imposed through the Services.
4.5 Account and Business Data
Clayface ordinarily acts as a controller when processing Account and Business Data, website information, marketing preferences, business communications, billing information, support information and Service Data for its own administrative, security and operational purposes.
5. Personal Data We Collect and Process
5.1 Information provided directly to us
We may collect Personal Data that an individual provides directly to us when the individual creates or administers an account, requests information or a demonstration, communicates with us, attends a meeting or event, submits a support request, signs up for communications, enters into a commercial relationship or otherwise interacts with Clayface.
This information may include the individual’s name, business email address, business telephone number, employer, organisation, job title, department, business address, account identifier, authentication information, communication preferences, marketing preferences and the contents of communications sent to us.
5.2 Customer and billing information
We may process information concerning Customer subscriptions, licence arrangements, billing contacts, invoices, transactions and payment status. Payment card or banking information may be collected and processed directly by an authorised payment service provider rather than stored by us.
5.3 Customer Content
We process Customer Content submitted by or on behalf of a Customer. The nature and extent of Customer Content depends on the Customer’s use of the Services and the information that the Customer chooses to submit.
Customers are responsible for determining whether Personal Data should be included in Customer Content, whether they have a valid legal basis or other authority to process it, which individuals may access it, the purposes for which it is processed and the period for which it should be retained.
5.4 Website and device information
When an individual visits a Clayface website or accesses the Services, we may automatically collect information concerning the individual’s interaction with the relevant website or service. This information may include the individual’s IP address, browser type, device type, operating system, approximate location derived from an IP address, referring and exit pages, pages viewed, access dates and times, session information, cookie identifiers and diagnostic, performance and security information.
5.5 Service Data
We may process Service Data relating to the operation and administration of the Services. Depending on the configuration of the Services, Service Data may include Customer and tenant identifiers, account and subscription information, authentication events, request volumes, resource consumption, feature use, system health information, latency, performance information, error codes, security events and other technical information required to operate, protect and support the Services.
5.6 Clayface External Intelligence
Clayface External Intelligence may contain identity, professional, business, contact, public-content and engagement information relating to individuals.
Identity and professional information may include a name, username, handle, public profile identifier, public profile image, biography, profile description, professional role, job title, company or organisational affiliation, employment history, education, qualifications, publicly stated expertise and links to public professional profiles.
Business contact information may include a business email address, business telephone number, business address, company website and other contact information made available for professional or commercial purposes.
Public content may include public posts, comments, reviews, ratings, articles, interviews, public statements, press coverage, business listings, photographs, videos, public responses, timestamps, source URLs and associated engagement information.
Business and engagement information may include company affiliations, professional networks, publicly disclosed business relationships, public engagement metrics, follower or subscriber counts, ratings, review information, achievements, awards, public recognition and other publicly accessible information concerning professional, creator or business activity.
5.7 Derived and enriched information
We may derive, generate or enrich information by analysing Personal Data and other information available to the Services. Derived information may include summaries, classifications, topic labels, category labels, entity mappings, relationship mappings, relevance rankings, matching indicators, trend analysis, duplicate-record indicators, identity-resolution indicators and indicators relating to the reliability or provenance of source information.
5.8 Sensitive Personal Data
Because Clayface External Intelligence may be obtained from broad public and third-party sources, it may incidentally contain information that is regarded as sensitive or special-category Personal Data under applicable law.
Clayface is not designed primarily to identify or infer sensitive characteristics about individuals. We may limit, restrict, remove or suppress sensitive information where required by law, where the information is not necessary for an approved purpose or where its continued processing would create a disproportionate risk to an individual.
Customers must not use the Services to infer, profile or make decisions based on sensitive characteristics except where the use has been expressly approved by us and is lawful in the relevant jurisdiction.
6. Sources of Personal Data
6.1 We may obtain Personal Data directly from individuals, Customers, Authorised Users, Customer-configured systems, integrations, service providers, commercial partners, licensed data providers, data brokers, publicly accessible websites, public social media pages, public reviews, public business listings, professional profiles, company websites, news sources, online publications, public databases and publicly accessible government, corporate or professional registers.
6.2 We may use automated technologies, to collect information from publicly accessible online sources where such collection and use are permitted under applicable law and subject to relevant source restrictions.
6.3 The public availability of information does not necessarily mean that the information may be processed without restriction. In determining whether and how Personal Data from public or third-party sources may be processed, we may consider the nature of the information, its source, the context in which it was made available, the reasonable expectations of the affected individual, the proposed purpose, applicable contractual restrictions and the rights and interests of the individual.
7. How We Use Personal Data
7.1 Provision of the Services
We process Personal Data to provide, operate, administer and maintain the Services. This includes creating and administering accounts, authenticating Authorised Users, provisioning Customer Environments, processing Customer instructions, retrieving and analysing information, responding to prompts, generating outputs, maintaining tenant-specific indexes and embeddings, enabling Customer-configured workflows and providing Customer-requested functionality.
7.2 Clayface External Intelligence
We process Clayface External Intelligence to compile and organise business, market and creator information; provide search, research, retrieval and analytical functionality; identify relevant individuals, companies, organisations, subjects and events; connect related information and records; generate source-based summaries; support Customer research and analysis; improve the accuracy, relevance and currency of External Intelligence; identify duplicate or outdated records; and provide actionable intelligence through the Services.
7.3 Account administration and customer relationships
We process Account and Business Data to administer accounts and subscriptions, manage Customer relationships, provide demonstrations, respond to enquiries, process payments, manage contracts, communicate with Customers and Authorised Users, provide support and send administrative or service-related notices.
7.4 Security and prevention of misuse
We process Personal Data and Service Data to authenticate users, maintain the integrity and availability of the Services, detect and prevent fraud, misuse, unauthorised access and security threats, investigate suspected violations, protect Customers and other individuals and respond to security incidents.
7.5 Service performance and improvement
We may analyse Service Data and aggregated or de-identified information to understand how the Services operate, measure performance, identify errors, improve reliability, optimise capacity, develop non-content functionality and improve the Customer experience.
We do not use Customer Content, Customer prompts or Customer-specific outputs to train, retrain or fine-tune shared or general-purpose artificial intelligence models.
7.6 Communications and marketing
We may use Account and Business Data to respond to communications and send information concerning the Services, product updates, events, research, offers and other business communications. Where required, marketing communications will be sent only with the individual’s consent or another valid legal basis.
7.7 Legal and compliance purposes
We may process Personal Data to comply with applicable laws, regulations, court orders, regulatory requests and other legal obligations; maintain corporate, accounting and tax records; enforce our agreements; protect our legal rights; resolve disputes; and establish, exercise or defend legal claims.
7.8 Additional purposes
We may process Personal Data for an additional purpose where that purpose is compatible with the purpose for which the information was originally collected, where the processing is permitted by law or where we have obtained any consent required under applicable law.
8. Artificial Intelligence and Model Processing
8.1 Use of AI models
Clayface uses artificial intelligence technologies to provide retrieval, analysis, summarisation and generation functionality. At the date of this Privacy Policy, the Services use Gemini models via Vertex AI, OpenAI models via Azure as an underlying artificial intelligence model.
8.2 Processing of prompts and outputs
Customer prompts, inputs and related information are processed solely to perform the operation requested by the Customer and generate the corresponding response, output or analysis.
The model deployment used by Clayface is configured so that Customer prompts, Customer Content and Customer-specific outputs are not used by the model provider to train, retrain, fine-tune or improve a shared or general-purpose model.
8.3 No training on Customer Content
Clayface does not use Customer Content to train, retrain, fine-tune or otherwise improve any shared, cross-customer or general-purpose artificial intelligence or machine-learning model.
This restriction applies to Customer files, documents, databases, internal business information, first-party data, prompts, instructions, messages, outputs, completions, embeddings, indexes and other Customer-specific content.
8.4 No training on Clayface External Intelligence
Clayface External Intelligence is used for retrieval, indexing, matching, classification, analysis and the generation of Customer-requested intelligence. It is not used to train or fine-tune or another foundation or general-purpose artificial intelligence model.
8.5 No cross-customer learning
A Customer’s use of the Services does not cause the shared Clayface External Intelligence repository or the underlying general-purpose model to learn from, incorporate or reproduce the Customer’s Customer Content, prompts, outputs, workflows or instructions.
Customer-specific activity does not update another Customer’s environment and is not made available to another Customer.
8.6 AI-generated information
AI-generated outputs may contain inaccuracies, omissions or incomplete information. We provide the services on an as-is and as-available basis. Customers are responsible for reviewing outputs and applying appropriate human judgment before relying on them, particularly where the information may affect an individual’s rights, interests or opportunities.
9. Legal Bases for Processing
9.1 Where applicable law requires us to identify a legal basis for processing Personal Data, we rely on one or more of the bases described in this clause.
9.2 Performance of a contract We process Personal Data where processing is necessary to enter into or perform a contract, provide the Services, administer an account, process a subscription or payment, provide support or take steps requested before entering into a contract.
9.3 Legitimate interests We may process Personal Data where processing is necessary for our legitimate interests or the legitimate interests of another person, provided that those interests are not overridden by the rights and interests of the affected individual.
Our legitimate interests may include providing business, market and creator intelligence; organising and analysing publicly accessible and licensed information; enabling Customers to perform research and analysis; maintaining accurate and current business information; improving the relevance of search and retrieval; administering Customer relationships; protecting the Services; preventing fraud and misuse; maintaining service reliability; and protecting our legal rights.
9.4 Consent We may process Personal Data based on consent where consent is required or appropriate, including in connection with certain cookies, optional marketing communications, integrations or other specifically identified processing activities. Consent may be withdrawn at any time, without affecting the lawfulness of processing undertaken before the withdrawal.
9.5 Legal obligations We may process Personal Data where necessary to comply with a legal, regulatory, tax, accounting, record-keeping or law-enforcement obligation.
9.6 Legal claims and vital interests We may process Personal Data where necessary to establish, exercise or defend legal claims or, in exceptional circumstances, to protect the vital interests of an individual or another person.
10. Disclosure of Personal Data
10.1 Customers and Authorised Users We make information available to the relevant Customer and its Authorised Users as necessary to provide the Services. Clayface External Intelligence may be made available to Customers through the Services in accordance with the applicable Customer agreement, approved use cases, use restrictions and applicable law.
10.2 Infrastructure and model providers We may engage cloud infrastructure, hosting, database, networking, storage, security and artificial intelligence inference providers to operate and provide the Services.
These providers may process Personal Data only for the purposes of providing the relevant service, under appropriate confidentiality and data protection obligations, subject to restrictions concerning retention and secondary use and in accordance with Phyllo’s instructions.
10.3 Business service providers We may engage providers of customer relationship management, communications, billing, payment processing, identity management, customer support, security, analytics, document management, professional services and business administration.
Except where necessary to operate the Services or where expressly authorised by the Customer, such business service providers are not permitted to process substantive Customer Content, including Customer files, prompts and outputs.
10.4 Customer-authorised integrations Where a Customer enables an integration, information may be disclosed to or received from the relevant integration provider in accordance with the Customer’s instructions. The independent terms and privacy practices of the integration provider may apply to its processing of the information.
10.5 Affiliates We may disclose Personal Data to current or future affiliates, subsidiaries and entities under common ownership or control where the disclosure is necessary to provide the Services, administer our operations or perform another purpose described in this Privacy Policy.
10.6 Legal and protective disclosures
We may disclose Personal Data where we reasonably believe that disclosure is necessary to comply with applicable law, legal process or a binding governmental request; investigate fraud, misuse or security incidents; enforce our agreements; protect the rights, safety or property of Company, a Customer or another person; or establish, exercise or defend legal claims.
10.7 Corporate transactions
Personal Data may be disclosed in connection with a proposed or completed merger, acquisition, financing, investment, reorganisation, insolvency, sale of assets or similar corporate transaction, subject to appropriate confidentiality and data protection safeguards.
11. Sale and Sharing of Personal Data
11.1 Customer Content Clayface does not sell Customer Content and does not disclose Customer Content to third parties for their independent advertising or marketing purposes.
11.2 Clayface External Intelligence Clayface makes External Intelligence available to Customers as part of a commercial subscription service. Depending on the applicable jurisdiction and the nature of the information made available, this activity may be characterised as a sale, sharing or other regulated disclosure of Personal Data.
11.3 Advertising Clayface does not use Customer Content to provide behavioural or targeted advertising. Information concerning cookies and website-related advertising practices is provided in Clause 17.
12. Data Security
12.1 We implement technical, organisational and administrative measures designed to protect Personal Data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure and unauthorised access.
These measures may include encryption in transit and at rest, Customer-controlled encryption keys, tenant isolation, identity and access management, role-based access controls, least-privilege access, multi-factor authentication, logging, monitoring, vulnerability management, secure development practices, incident-response processes and recovery controls.
12.2 Customer-controlled encryption keys Encryption keys used to protect Customer Content are controlled at the Customer end. Clayface does not own, control or have independent access to a Customer’s encryption keys. Clayface personnel do not have routine access to, or the ability to independently decrypt, Customer Content protected by Customer-controlled keys.
12.3 Support access Clayface may provide backend or technical support at the Customer’s request. Support personnel will not receive independent access to the Customer’s encryption keys.
Where support requires access to the Customer Environment or Customer Content, access must be initiated or expressly authorised by the Customer, limited to the information necessary for the support purpose, restricted to authorised personnel and time-bound where reasonably practicable. Relevant access activity may be logged and monitored.
12.4 Customer responsibilities Customers are responsible for protecting their account credentials, administering Authorised User permissions, securely managing encryption keys, configuring the Services appropriately and promptly notifying Clayface of suspected unauthorised access.
13. Retention of Personal Data
13.1 We retain Personal Data only for as long as reasonably necessary for the purposes for which it was collected or processed, including to provide the Services, comply with legal obligations, resolve disputes, maintain security and enforce our agreements.
In determining an appropriate retention period, we may consider the nature, volume and sensitivity of the information, the purposes of processing, the potential risk of harm, the Customer’s instructions, contractual requirements and applicable limitation, record-keeping and regulatory periods.
13.2 Customer Content
Customer Content is retained in accordance with the applicable Customer agreement, the Customer’s instructions, the Customer’s configured retention settings and applicable law.
Following termination or expiry of the relevant Customer relationship, Customer Content will be returned or deleted in accordance with the applicable agreement. Residual copies contained in backups may remain until they are overwritten or deleted through the applicable backup cycle, unless longer retention is required by law.
13.3 Clayface External Intelligence
Clayface External Intelligence may be retained while it remains relevant to the Services, while Phyllo has a lawful basis for processing it, while it is reasonably believed to remain accurate and current or while retention is required for legal, compliance, security or dispute-resolution purposes.
We may update, archive, restrict, suppress or delete External Intelligence that is inaccurate, outdated, no longer necessary or subject to a valid privacy request.
13.4 Account and Business Data Account, billing, contractual and business records may be retained for the duration of the relevant business relationship and for any subsequent period required to comply with tax, accounting, contractual, regulatory and limitation requirements.
14. Individual Privacy Rights
14.1 Depending on the individual’s location and the applicable law, the individual may have the right to request access to Personal Data, obtain information concerning its processing, correct inaccurate information, complete incomplete information, request deletion, restrict processing, object to processing, withdraw consent, request portability, opt out of certain sales, sharing or targeted advertising, limit certain uses of sensitive Personal Data, appeal the denial of a request and lodge a complaint with a competent privacy or data protection authority.
These rights may be subject to legal conditions, limitations and exceptions.
14.2 Requests concerning Customer Content Where Personal Data was submitted to Clayface by or on behalf of a Customer, the Customer ordinarily controls that information. Individuals should direct their request to the relevant Customer. Where required by the applicable Customer agreement or law, Clayface will provide reasonable assistance to the Customer in responding to a valid request.
14.3 Requests concerning Clayface External Intelligence
Individuals may contact Clayface directly to request access to Personal Data concerning them, information regarding the categories or sources of that information, correction of inaccurate information, deletion, restriction of processing, objection to continued processing or suppression from future collection.
14.4 Verification We may request information reasonably necessary to verify the identity of the person submitting a request, confirm the person’s authority to act on behalf of another individual and locate the relevant information.
We will use verification information only for the purposes of assessing and responding to the request, preventing fraud and maintaining appropriate records of the request.
14.5 Correction and deletion
Where we validate a request concerning Clayface External Intelligence, we will take reasonable steps, as required by applicable law, to correct, delete, restrict or suppress the relevant information in systems under our control.
Where technically practicable and legally required, we may also propagate the correction, deletion or restriction to active Customer Environments containing the relevant External Intelligence and notify recipients to whom the information was disclosed.
We may retain limited information where necessary to prevent deleted information from being collected again or to demonstrate that the request has been honoured.
14.6 Response period and appeals
We will respond to valid requests within the period required under applicable law. Where permitted, we may extend the response period where a request is complex or numerous, and we will provide notice of any extension.

15. Accuracy of Clayface External Intelligence
15.1 Clayface External Intelligence is obtained from public and third-party sources and is provided in an as-is and as-available basis. Such information may be incomplete, outdated, duplicated, incorrectly attributed or otherwise inaccurate.
15.2 Clayface does not guarantee that all External Intelligence or AI-generated outputs are complete, current or error-free. The inclusion of information within the Services does not constitute an endorsement of the individual, organisation, statement or source to which the information relates.
15.3 Customers must independently assess the relevance, reliability and accuracy of information before relying on it, particularly where the Customer’s use may materially affect an individual.
15.4 Individuals may request correction or deletion of External Intelligence using the process described in Clause 14.
16. Permitted Uses and Automated Decision-Making
16.1 The Services are designed to provide research, retrieval, summarisation, analysis and intelligence functionality. Clayface does not independently use External Intelligence to make decisions that produce legal or similarly significant effects concerning individuals.
16.2 The specific permitted purposes for which a Customer may use the Services are determined through the applicable Customer agreement, order form, approved use case and product documentation.
16.3 Customers are responsible for assessing whether their use of the Services involves profiling, monitoring, automated decision-making or decisions concerning employment, credit, insurance, housing, education, healthcare, access to essential services or other matters that may materially affect an individual.
16.4 Customers must implement any legal basis, notice, consent, human review, impact assessment and safeguard required for their use of the Services.
16.5 Clayface may prohibit, restrict or impose additional conditions on a proposed Customer use that creates an unacceptable legal, privacy, security, ethical or reputational risk.
17. Cookies and Similar Technologies
17.1 We may use cookies, pixels, local storage and similar technologies on Clayface websites and services to provide essential functionality, maintain sessions, authenticate users, secure accounts, remember preferences, understand usage, measure performance and support marketing activities where permitted.
17.2 Where required by applicable law, non-essential cookies will be used only after the individual has provided consent. Individuals may manage available cookie preferences through the applicable cookie settings interface.
17.3 Where required under applicable law, we will recognise and respond to legally valid browser-based opt-out preference signals.
18. Marketing Communications
18.1 Individuals may opt out of promotional email communications by using the unsubscribe mechanism included in the relevant communication or by contacting us.
18.2 An individual who opts out of promotional communications may continue to receive non-promotional communications relating to an account, subscription, security matter, transaction, support request or other administrative issue.
19. Children’s Personal Data
The Services are intended for business and professional use and are not directed to individuals under the age of eighteen. We do not knowingly permit individuals under the age of eighteen to create Clayface accounts. Clayface External Intelligence is not designed primarily to identify, profile or maintain records concerning children.
Where we become aware that information primarily concerns a child and its processing is not necessary or lawful, we may delete, restrict or suppress the information. A parent, guardian or other authorised person may contact us using the details provided below.
20. Third-Party Websites and Services
The Services may contain links to third-party websites or permit Customers to connect third-party products and services. We do not control the independent privacy, security or data practices of those third parties. Customers and individuals should review the relevant third party’s privacy notice and terms before enabling an integration or providing information to that third party.
21. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to the Services, data sources, processing activities, technology, service providers, legal requirements or business practices. The updated Privacy Policy will identify the date on which it was last revised. Where required by law, we will provide additional notice of a material change or obtain consent before applying the change.
